Planning Board Minutes 04/12/10

Present:  Chairman Tom LaPerch; Boardmembers Edwin Alvarez, Jim DiBella, Phil Wissel, Dan Armstrong; Town Planner Ashley Ley; Town Counsel Willis Stephens, Esq.; Secretary Laurie Fricchione.  Boardmembers Dennis Sullivan and David Rush were absent and excused.

PUBLIC HEARING:

1.            TEMPLE BETH ELOHIM AMENDED SITE PLAN, Mt. Ebo Corporate Park – This item was on the agenda for site plan review regarding a proposed fence installation.  Terri-Ann Hahn appeared before the Board on behalf of her client.  Proposed is the installation of an approximately 160 square foot fenced in area within which the children could play outdoors.  In the audience, Lynne Eckhardt suggested at the prior ARB meeting that there be some landscaping provided to offer screening.  Ms. Hahn responded that there will be some plantings added to the drawings which will be submitted to the ARB in another meeting for the ultimate approval by the Town Board and then the applicant will come back to the Planning Board to receive Final Amended Site Plan Approval.  A motion to close the public hearing was introduced by Chairman LaPerch, seconded by Boardmember Wissel and passed 4-0 in favor, 2 absent, 1 recusal [DiBella].

REGULAR SESSION:
  • PALUMBO SAND AND GRAVEL SITE PLAN, Fields Lane – This item was on the agenda for a Declaration of Lead Agency for purposes of SEQRA.  The resolution was introduced by Boardmember Armstrong, seconded by Boardmember Wissel and passed 5-0 in favor, 2 absent.
  • SOMCHAI REALTY AMENDED SITE PLAN, Route 22 – This item was on the agenda for sketch review of the parking area.  Phil Doyle of LADA, Judson Siebert, Esq. of Keane & Beane, the applicant’s attorney, as well as Dov Matz, the owner, appeared before the Board.   This project was originally approved in 1983 and in 1998 applied for and was approved for a site plan modification for parking expansion, although never was completed.  Over the years, the parking area (which allows parking for 12 trucks) has been over-utilized and Cintas now has more trucks parked on their property than what was originally allowed; hence, the site plan amendment application now before the Board.  Mr. Doyle visited the site recently and stated that there were 18 trucks on the site.  He also acknowledges that trucks have in the past parked along Route 22 as well as along the entrance driveway to the building.  The applicant’s intentions are to keep the parking area at 12 which would mean the extra trucks will be parked off-site not within the Town of Southeast, to plant trees which are no longer viable to create a visual barrier for the rear-yard neighbors, and to construct a guardrail so as not to allow the delivery trucks or employees’ vehicles to creep further beyond the delineated parking area.   It was mentioned that there were never enough trees (as only 6 or 7 trees were planted) to create a visual buffer and they were so small that they were run over by the trucks and did not live.  Ms. Ley suggested that a lighting plan should be submitted for review due to the fact that lighting regulations have changed since 1998 and need to be in conformance to the extent possible.  She also suggested that the Wetland Inspector should visit the site to determine the extent of wetland buffer activity and possible disturbance also due to the wetland regulations having changed since 1998.  Mr. Doyle indicated that a new survey will be submitted for further review and clarification of the existing site conditions.
  • REPORT AND RECOMMENDATION TO TOWN BOARD ON COMPREHENSIVE PLAN UPDATE – Due to the fact that two Planning Boardmembers were not present, this item was placed on the April 26 agenda for a discussion and vote.
A motion to accept the minutes of the March 22, 2010 minutes was introduced by Chairman LaPerch, seconded by Boardmember Wissel and passed 5-0 in favor, 2 absent.
A motion to close the meeting was introduced by Chairman LaPerch, seconded by Boardmember DiBella and passed 5-0 in favor, 2 absent.
